Designer–Maker Model License & Production Agreement

This agreement is formed directly between a Designer and a Maker: stampista.com is not a party to it, does not sign it, and has no obligations or liability under it. It only records that both sides reviewed and accepted it, and stores the timestamp and version accepted. See the Terms of Service, section 5, for how this agreement fits into the platform's rules.

1. When this agreement applies

This agreement is automatically formed between a Designer and a Maker the moment a partnership is confirmed on stampista.com for a specific Project: that is, the moment an offer between them is accepted (whichever side clicks "Accept," after checking the box confirming they have read and agree to this text). A Designer may have several Makers partnered on the same Project at once; a separate instance of this agreement exists for each individual Designer–Maker–Project combination.

2. What is licensed

By confirming a partnership, the Designer grants the Maker a limited, non-exclusive, non-transferable, revocable license to download, store, and use the 3D model files (STL or other print-ready files) attached to that specific Project, solely for the purpose described in Section 3 below.

The Designer represents that they own the intellectual property rights to these files, or hold a valid license entitling them to grant this right to a Maker, the same representation they already made when confirming IP ownership on their stampista.com profile.

3. Permitted use: production against confirmed orders only

The Maker may use the licensed files only to produce (3D print) physical copies of the Project in fulfillment of orders placed and confirmed by the Designer through stampista.com's order system. Any production run must correspond to a real order the Designer has authorized.

The Maker may not:

  • use the files to produce or sell copies outside of orders confirmed by the Designer on the platform;
  • share, publish, upload, re-sell, sub-license, or otherwise transfer the files (in original or modified form) to any third party;
  • use the files, or physical items produced from them, for any purpose other than fulfilling the Designer's confirmed orders (including as portfolio samples, marketing material, or on any other platform) without the Designer's separate written permission;
  • retain or use the files for any Project once the partnership on that Project has ended (see Section 4).

4. Duration and termination

This agreement stays in effect only while the partnership is active, i.e., while the underlying offer's status is "accepted" on stampista.com. Either the Designer or the Maker may end the partnership at any time (the "Revoke" action), which immediately terminates this agreement for that Designer–Maker–Project combination.

Ending the partnership does not cancel or affect any order already placed before termination: that order is completed, shipped, refunded or otherwise resolved under the platform's normal order rules regardless of the partnership's status.

5. Duty to stop using and delete the files after termination

Once this agreement ends for a given Project (Section 4), the Maker must, within 7 days:

  • immediately stop using the corresponding files for any further production;
  • permanently delete every copy of the files in their possession or control (including local downloads, slicer/print-preparation project files derived from them, and any copies on printer storage or cloud/backup storage), except a copy may be retained only as long as strictly necessary to complete an order that was already confirmed before termination.

6. Files stay with the Designer's other partnerships

Ending this agreement with one Maker has no effect on any other active partnership the Designer may have on the same or a different Project; each Designer–Maker–Project pair is governed by its own separate instance of this agreement.

7. No warranty, no platform liability

The files are provided "as is." stampista.com makes no representation about the accuracy, printability, or fitness for purpose of any file, and is not a party to, and has no liability under, this agreement; see the platform's Terms of Service for the full allocation of responsibility between Designers, Makers, and the platform.

8. Governing law

This agreement is governed by Italian law, consistent with the Terms of Service. Nothing here limits either party's statutory rights.
